ORDER
This cause came on to be heard on Plaintiffs' Motion to continue
and the Motion of Defendant, SHAIR A. RHUDDUS, M.D., to compel discovery or
in the alternative to impose sanctions, and the Court having heard argument
of counsel for all parties, and being otherwise advised in the premises,
it is
ORDERED AND ADJUDGED that Defendant, SHAIR A. RHUDDUS, M.D., shall
be permitted to depose the witness, Emidio A. Bianco, M.D., within 30 days of
the date of entry of this Order, and upon failure of the Plaintiffs to produce
Emidio A. Bianco, M.D., for the purpose of taking his deposition, said witness
shall not be allowed to testify at any proceeding is this matter, and it is
further
ORDERED AND ADJUDGED that Plaintiffs' Motion for continuance is
hereby granted and this cause shall be and hereby is set for trial on the
5th day of November 1979, at 9:30 A.M., case on the
docket, Pre-Trial Conference is hereby reset and shall be heard on the 17th
day of October 1979, at 9:30 A .M., at Hearing Room 101,
in the Saint Lucie County Courthouse, Fort Pierce, Florida, and it is further
ORDBRED AND ADJUDGED that further continuances of this matter
requested solely upon the grounds of nanavailability of expert witnesses shall
not be granted.
