ORDER
This matter came on for consideration upon
defendants' Motions to Dismiss, to Drop Defendant
Robert J. Tiernan, and to Strike. A hearing was held
on August 28, 1979. The court has reviewed the file, -
considered the arguments of counsel, and has been other-
wise fully advised. It is
ORDERED AND ADJUDGED that defendants' Motion _
to Dismiss the Complaint for failure to state a cause
of action is denied; defendants' Motion to Dismiss
Count II of the Complaint for lack of jurisdiction and
improper venue is denied; defendants' Motion to Drop
t Defendant Robert J. Tiernan is denied; defendants' Motion _
to Strike plaintiff's claim for attorney's fees in
Count II of the Complaint is denied.
FURTHER ORDERED AND ADJUDGED that defendants'
Motion to Strike plaintiff's-claim for attorney's fees
in Count I of the Complaint is granted without prejudice
to the right of plaintiff to renew its claim for attorney's
fees against defendant Warren's Laundry & Cleaners of
Fort Pierce, Inc., pursuant to Section 57.105, Florida
Statutes (1978 Supp.), following the filing of an Answer .
by said defendant.
