STIPULATED MOTION TO DISMISS
COME NOW the Plaintiffs, FAVIAN LEE PICANO and
JOHN PICANO, and a certain specified business entity
known as PLASTIC INDUSTRIES, INC., by and through their
undersigned attorneys, and hereby jointly agree and
stipulate to entry of an Order which will dismiss from
this lawsuit a certain, specified business entity known
as Plastic Industries, Inc. To the best of their present
knowledge, the parties believe the following statements.
to be true:
(1) That by coincidence only, there are two
business entities known as Plastic Industries, Inc.
Although the names of these two businesses are identical,
there is no legal relationship between the two.

(2) That Plaintiffs initially sued and served
process on the wrong Plastic Industries, Inc. So as to
distinguish the two separate companies bearing the same
name, the one initially wrongfully sued:
(a) Is either a corporation incorporated in
Florida or Pennyslvania.
