(b) Operates a business in Florida at
20600 North East 5th Avenue in Pompano Beach, Florida.
(c) Has liability insurance coverage with
Kemper Insurance Companies.
(d) Has Karl Brass as its general manager in
Florida.
(e) Does manufacture certain plastic pipe
fittings.
(f) Has at no time had any business dealings
or relationships with Kroehler Manufacturing, The Hon Company,
Murphy-Miller Division, or Halsey & Griffith, Inc.
(g) Did not design, manufacture, assemble;
distribute, or have anything to do with any plastic component
parts composing the swivel-base chair which allegedly
collapsed so as to give rise to this lawsuit.
(3) That there is a separate and distinct Plastic
Industries, Inc. which:
(a) Is believed to be a business entity incorporated
in Tennessee.
(b) Has liability coverage through Royal Globe
I Insurance Companies.
(c) May have had dealings with Kroehler Manufacturing, _
The Hon Company, Murphy-Miller Division, or Halsey & Griffith, Inc.
(d) May have produced plastic component parts
which were used in swivel-base chairs such as the one which
allegedly collapsed.
(4) So as to rectify the pleadings and allow Plaintiff s
to proceed forward with their lawsuit, the parties hereby
agree and stipulate to entry of an Order dismissing from this
lawsuit that certain, specified business entity know as
Plastic Industries, Inc. which is Florida based and has its
liability coverage through Kemper Insurance Companies, while
at the same time allowing Plaintiffs to proceed forward, if
