HomeMy WebLinkAbout1459 t ' ~ ~ S-8686 CSM/ab . ` RECEIPT, ACKNOWLEDGMENT, ASSUMPTION AND ACCEPTANGB Of 1'U[~CHASER Purchaser, by acceptance and execution of this Receipt, acknowledges that this purchase of a condominium unit at OCEAN VILLAGE OF HUTCHINSON ISLAND o c n4clsrs~{_±,~ ~+f (',nnrinm~Yliu~ as to the condominiun in which his unit is located and Exhibits attached thereto, including but not limited to (whether the same are attached to the Declaration of referred to therein), the By-laws of the Association Articles of Incorporation, the Rules and Regulations, copy of pro3ected operating budget, copy of sales brochure and floor plan of apartment purchased by Purchaser, and aII Amendments to the aforesaid De- claration and Exhibits and the Articles of Incorporation, By-Laws and Declaration of Covenants and Restrictions of the Property Owner's Association; an$ Purchaser further acknowledges receipt of and reading and examination of said Declaration, its . Exhibits, and budget, sales brochure and floor plan, and acknowledges that each and . every provision of the foregoing is essential to the successful operation and manage- ment of the Condominium property and is~in the best interests and for the benefit of all the. owners therein. Purchaser and all owners of parcels in the aforedescribed Condominium covenant and agree to abide by each and every provision of said Declar- ation of Condominium and Exhibits attached thereto. Purchaser hereby ratifies and confirms and approves all~of the terms and provisions of said Declaration of Condo- minium and Exhibits attached thereto, and agrees that the assessment under the Property Owner's Association documents referred to above and the provisions thereof are reasonable, fair and equitable, and said Purchaser acknowledges and.confirms that--the Declaration -of-Covenants--and Restrictions-of-the-Property-Owner--'s-Association-- has encumbered and impressed a lien upon the Condominium parcel-being conveyed to Purchaser, as security for his obligations under the said-Declaration of Covenants and Restrictions of the Property Owners' Association and said Purchaser assumes the obligations as to the Property Owner's Association as to his condominium parcel. Purchaser confirms that all warranties, representations and inducements, if any, are as contained in the aforesaid Declaration of Condominium and Exhibits attached there- to, and the common expenses and .the sums due under the Property Owner's Association and other char~es_are estimated only. No warranty or guaranty is made or intended nor may one be relied except where the same is specifically warranted-or guaranteed in said Declaration of Condominium and the Exhibits attached thereto.
