Defendants .
This matter initially came to be heard upon the Defendant,
McGowan's Motion to Amend Order of August 31, 1979. Subsequent thereto,
all parties stipulated and the_Court agreed to the entry of the
following:
Each party is required to serve upon every other party
prior to the close of business on October 8, 1979 the following
lists
1. A witness list naming all wirnesses, both expert
and non-expert, that a party intends to call to testify at the Mediation
Hearing. Either the home or business address of each witness shall
also be provided on the witness list.
2. An exhibit list listing all exhibits of any nature
whatsoever that a party intends to introduce at the Mediation Hearing.
Failure to list a witness on the witness list or to list
an exhibit on the exhibit list will preclude a party from using
said witness or exhibit at the Mediation Hearing.
It is further ordered that discovery shall remain open until
3:00 p.m. on November 14, 1979.
During the discovery period all parties are entitled to
take depositions of all expert witnesses intended to be used in the
Mediation Hearing. Depositions of non-expert witnesses not heretofore
