Riparian or littoral rights of any other person or entity. The right, if any, of the public to use as a public beach or recreation area any part of the land lying or formerly lying between the body of - water abutting the subject property and the natural line of vegetation, bluff, extreme high-water line or other apparent boundary line separating the publicly used area from the upland private area, or such upland private area-as it may have-existed prior to the construction., if any, of sea wall or bulkhead thereon. Any rights of the State of Florida, St. Lucie County Board of County Commissioners or the public established by the St. Lucie County Beach Control Line. Any rights of Ronald M. Gradsky, a single man, and/or M. L. Noelke a/k/a Mary Lee Noelke under that certain Quit Claim Deed dated the 28th day of November, 1973, and recorded in O. R. Book 221,- Page 1297 in the Public Records of St. Lucie County, Florida. Any rights of Harry M. Alder and Marjorie Silver Alder, husband and wife, under that certain Quit Claim Deed dated the 5th day of February, 1974, and recorded in O. R. Book 223, Page 1653 in the Public Records of - St. Lucie County, Florida. That certain first Mortgage Deed dated December 23, 1974 from JACK- CUMMINGS, AS TRUSTEE, Mortgagor, to RONALD HOWE, AS TRUSTEE, Mortgagee recorded in O. R. Book 234, Page 2830 of the Public Records of St. Lucie County, Florida, given to secure the sum of $365,000.00. That certain Purchase Money Wrap Mortgage Deed executed simultaneously - herewith from ROBERT L. LIPTON, as Mortgagor, to JACR CUNNINGS, TRUSTEE, as Mortgagee, securing a note in the sum or $740,000.00. By acceptance of this deed grantee represents and warrants that the Subject Property (which is presently vacant) is not being acquired by Buyer with a view towards utilizing same or any part thereof as Buyer's homestead or residence. Grantor does not warrant or represent or guarantee mineral rights being-fully vested in the property herein conveyed.
