HomeMy WebLinkAbout0237 ~ - ~ { { 5. The Plaintiff may bid for and be the purchaser of the 4 property at the sale and may-bid the mortgage lien as cash up to the amount secured by the mortgage. Should the Plaintiff be the successful bidder, then. after confirmation of the sale,-wheL-her_ such confirmation be by the Clerk filing. the Certificate of Title as provided by statute, or by Order of this Court, the Plaintiff shall pay all of the items and amounts as provided in Paragraph 4a above. The Plaintiff shall, after making all of said payments, - credit the balance of the amount bid against the amount due under this Judgment. i - 6. After confirmation of the-sale, whether by_the Clerk filing his Certificate of Title, or by the Court, each Defendant and all persons claiming any right, title or interest in and to said property by or through-the Defendant(s) or any of them, or otherwise, since the commencement of this suit are severally b,~rred and foreclosed of and from any-and all right, title,_interest, claim, _property, possession, or demand in or to the property, and the purchaser at the sale and the purchaser's grantees-or agents shall be let into possession of the property. - _ 7. After the entry of the Final Judgment of Foreclos~;re - and-Sale,-and upon the furnishing and substitution of a photoccpy of the original 1?lortgage Note, Mortgage and Assiynment of Mortgage, the Clerk is authorized and directed to withdraw and deliver the originals of the Mortgage Nate, Dortgage and Assignment bf Mortgage to the attorneys of record for the Plaintiff. _ - 8. This Court retains jurisdiction of this cause, and the parties thereto, for the purpose of making such further orders and judgments as this case requires.
