_Pre-Trial conference, having been-held, it is
ORDERED AND ADJUDGED: _ -
1. STIPULATIONS AND ADMISSIONS are made as follows: Generally
the facts submitted in the Pre-Trial Statement of Plaintiff were
agreed upon, said facts being the following: -
(a) Gulf Oil is the general partner of HUTCHINSON ISLAND ~ '
LIMITED PARTNERSHIP. -
(b) On or about Ap=i1 15; 1977, HUTCHINSON ISLAND LT_MITED
PARTNERSHIP and Ologistics, Inc:, entered into a preliminary
letter agreement calling for the construction by Ologistics, Inc._
of 80 condo apartments on behalf of HUTCHINSON ISLAND LIMITED
PARTNERSHIP; on land owned by HUTCHINSON ISLAND LIMITED PARTNER-
SHIP.
(c) On or about June 1, 1977, Defendant, Ologistics, Inc.,- -
and Defendant HUTCHINSON ISLAND LIMITED PARTNERSHIP entered into
a construction contract.
(d) On or about March 1, 1978, Defendant, H~JTCHINSON ISLAND
LIMI~'D PARTNERSHIP, admits that it issued a check payable jointly
to ROBE SOUND NATIONAL HANK and Ologistics,.Inc., in the face
amount of $233,068.00 and further admits that on March 2, 1978,
- Defendant, HUTCHINSON ISLAND LIMITED, stopped payment or. said
check.
2. EVSDEttCE: Documentary and other evidence listed and
presented at the Pre-Trial Conference shall be admitted into
