THIS CAUSE coming on to be heard for Final -
Hearing and the Court hearing evidence that the~Plaintiff,
LANDMARK FIRST NATIONAL-BANK OF FORT LAUDERDALE, a National
Bank, has been unable to locate the property which was the
subject of this action, to-wit: One (1) used Allis Chalmers
front end loader, Model-940 (Articulated), ID~1015, and the
Writ of Replevin issued pursuant to this action having been -
returned-by the Sheriff of St. Lucie County unexecuted-due to
the fact that the property could not be located, and it
appearing to the Court that the-property is not obtainable at
this time, and the Court having found and determined that the
- Plaintiff has the sole right of ownership and possession of said
property, and the Plaintiff having elected to obtain a money
judgment for damages in lieu of the return of said property,
and the Court having considered the Security Agreement and Note _
entered into by the§Plaintiff and the Defendants, CERTIFIED
READY-MIX, INC., a dissolved Florida corporation, and ROBERT
GALLO, individually, and the Court being otherwise fully _
advised in the premises, it is,
