10. (a) the Mortgagor hereby assigns to Mortgagee and
grants to Mortgagee a security interest in the rents, issues
and profits of the Mortgaged Property as further security,
for the payment of the indebtedness secured hereby and the
Mortgagor grants to Mortgagee the right to enter the Mortgaged
Property for the purpose of collecting the same and to let
the Mortgaged Property, or ,any .part thereof, and to apply t
said rents, issues and profits after pa~naent of all necessary
charges and expenses, on account of said indebtedness; that
this assignment and grant shall continue in_effect_until the
indebtedness secured by this Mortgage is paid, but Mortgagee
hereby waives the Xight to enter the Mortgaged Property for
the purpose- of collecting said rents, issues and profits,
and Mortgagor shall be_entitled to collect and receive said
rents, issues and profits,-until the occurrence o~ a default
by Mortgagor under the terms and provisions hereof, that
Mortgagor agrees to use said rents, issues and profits in -
payment of principal and/or interest payable pursuant to the
Proatissory Note, and in .payment of all taxes, accounts and _ -
other charges on or .against the Mortgaged Property; and such
right of Mortgagor to collect and receive said rents, issues
and profits may be revoked by Mortgagee upon an~ default by
Mortgagor-under the terms and provisions of this Mortgage;
that:Mortgagor shall not have the right or power, as against
the holder of this Mortgage without its consent, to cancel,
abridge or otherwise modify tenancies or leases of the
Mortgaged Property, or any part thereof, inexistence on the
date of this Mortgage-(except for tenancies or leases in
which the lessee is in default), or-to accept prepayments of
installments of rent to become due thereunder for-a period
or more than one (1) month in advance (excluding. security
deposits); that, in respect of any such lease which now or
at any time is covered by such restriction, Mortgagor will -
(a} fulfill or perform each and every term, covenant and
provision of any such lease to be fulfilled or performed by
the .lessor hereunder or thereunder; (b) give prompt notice
i to Mortgagee of any notice received by Mortgagor of default
f by the lessor thereunder, together with a complete copy of
any such notice, and (c) enforce, short of termination
~ thereof, the performance or observance of each and every
term, covenant and provision of any such lease by the lessee
thereunder to be performed or observed.
(b) To further secure the-indebtedness secured
hereby, Mortgagor hereby grants to Mortgagee a security
interest in all property and fixtures affixed to or located
on the property described herein which to the full est extent
permitted by law shall be deemed fixtures and part of the
real property, all articles of personal property .and all
materials delivered to the property described herein for the ~
use in any construction being conducted thereon and owned by
Mortgagor, all inventory, contract rights, general intangi-
bles, accounts, and rights in action, including all rights
to insurance proceeds and all proceeds,. products, replace- -
ments, additions, substitutions, renewals and accessions of -
any of the foregoing. Mortgagor herebY~c~rants to Mortgagee
a security interest in all fixtures, rights in action,
personal property descrbed herein. This mortgage is self-
operating security agreement with respect to such property,
but Mortgagor agrees to execute-and deliver on demand such
other security agreements, financing statements and other
instruments as Mortgagee may rquest in order to perfect a
security interest or to impose the lien hereof more speci-
fically upon any such property., Mortgagee shall have all
the rights and-remedies in addition to those specified
