ADDENDU*1
ADDEi+lDUM to Contract ~~-9g2-11 , dated August 23rd., 1979 between
TROPICANA PRODUCTS, INC. , and - S. N. 1Q1IGSr b~ SONS, INC. -
Where this AaDENDUM-may b~ inconsistent M-ith the printed portion of the
Contract, the terms of the ADDENDU*i shall prevail:
1. Notwithstanding the provisions of the contract, Tropicana Products, - _
Inc.'s participation price paid to Seller will be ds_computed in
- the contract, but rill not be less-than: -
A. ninety-five ($.95~ cents per pound solids in-the 1979-1980
_ season, upon delivery of that fruit to Tropicana's plant,. less -
applicable taxes-and any other authorized deductions, or
• B. eighty (80X) percent of Tropicana Products, Inc.'s~Daily Cash
_ Market Price, if greater than Paragraph A above, less applicable -
taxes .and any other authorized deductions, upon delivery of that
- fruit to Tropicana's plant.
2. It is also understood that the prices set forth above are guaranteed
prices for the year indicated. The actual price gill be determined
by the formula provided in the contract if it exceeds the guaranteed
price provided for herein. - -
3. it is further agreed that Tropicana Products, Inc.'s HAUL rate to be
5.20 per 90 pound weight box if hauled within thirty (30) miles of the
Ft. Pierce plant, and the HAUL rate to be $.30 per 90 pound weight box
if hauled more than thirty (30) miles from the Ft. Pierce plant. In
the event that the Ft. Pierce-plant shuts down before the harves~ of
the fruit is completed, these local rates will apply_to fruit trans-
- ported to Bradenton, Florida. _

4. It is agreed betzreer. Tropicana Products, Inc., the Buyer, and }
S.N. RniRht ~ Sons, Inc. the-grower, that .Specialty Fruit produced
by the Grower-from his grove, and not used in other areas of utiliza-
Lion will be received from the Grower, and the payoff Will be based on
the early and midseason participation payoff Less:
