- TROPICAh.A PRODUCTS, IBC,., and FRANK M~ADB, JR.
Where this :~DDEhDtTM may beinconsistent with the printed portion of the .
contract, the terms of the ADDENDUM shall prevail. '
-l. ?:o:withstanding the provisions of the contract, Tropicana Products,
- inc.'s participation price paid to Seller :ill be as computed in
the .contract, but will not be less than: -
A. ninety ($.90) cents per pound solids in the 1979-1980 season,
eighty ($.80) cents per pound solids in the 1950-1981 through
1983-1984 seasons, upon delivery of that fruit to Tropicana's
plant, less applicable taxes and--any other authorized deductions,
or,
B. eighty (8090 percent of Tropicana Products, Inc.'s Daily Cash
Market Price, if greater than Paragrapr A above, less applicable -
taxes and any other authorized deductions, upon delivery of that
fruit to Tropicana's plant. - -
2. In consideration for this guaranteed price, Seller agrees that this
contract cannot be terminated during this five (S) year period, and
that the contract may continue after the 1983-1984 season in accord-
. once with the regular terms of the participation-agreement. _ _
3. It is also understood that the prices set forth above are guaranteed
prices for the years indicated. The actual price will be determines
_ by the formula provided in the contract if it exceeds the guaranteed
price-provided for herein. - -
