THIS CAUSB having come on for non-jury trial on the
14th day of Sep~enber, 1979, and the Court having considered all
of the evidence and argument of counsel, finds and determines:
-This is an action for an injunction to require .the
Defendants to construct certain condominium known as Phase III
to conform in structure, design, size of units and in aesthetics -
with the buildings presently ezisting in Phases Land II. _
Certain issues and disputes between the parties have
been resolved in accordance .with stipulation of the parties, and
the Court confirms and ratifies this stipulation and incorporates
the terms of this stipulation in this final judgment. _
The corporate Plaintiff is an Aseociation~which has
been designated by the Declaration of Condominium to manage the
condominium in all three phases. The individual Plaintiffs are
owners of individual apartments in Phase II of the condominium.
The corporation Defendant is the owner of the land- in Phase II
and was the original developer of. Phases I and II. The individual

Defendant is the president of the Defendant corporation and sole

stockholder. ~
Defendants were the owners and developers of Phases I
and II, and proposes to build and complete Phase III. Phases I
and II were developed under separate Declarations of .Condominium,
but the Declaration provided that Island House Owners Association,
