- DECLARATION OF TRUST -
•
This Declaration of Trust made this 21st day of January; 1977, {
executed by BOBBY HENDRY, hereinafter called the grantee-trustee, as -
regards and-concerns that certain property described in a deed recorded
in O.R. Book-124, Page 483, Taylor County, Florid. - ~ ,
The Trestee acknowledges that he has received a deed from
LASSIE STRIPLING, his mother, and that the conditions of the deed being ~
made to BOBBY HENDRY were as follows,- to-wit:. Tha* BOBBY HENDRY should
- hold in trust the property deeded to him from LASSIE STRIPLING and acting
as said trustee for both himself, BOBBIE HENDRY, and his brother, GEORGE
HENDRY, at all times acting within his discretion to the best interest of . - -
the grantor, LASSIE STRIPLING and GEORGE HENDRY and BOBBY HENDRY.
That it is the desire of both the grantor and the grantee that
the grantee as the trustee manage and preserve the property deeded by the
..said grantor to the best interests of-the beneficiaries, GEORGE HENDRY,
BOBBY HENDRY and LASSIE STRIPLING, with the trustee to hold, manage and
control the property having discretionary rights therein for the benefit
of-the named beneficiary. -
' That in the absence of the trustee, BOBBY HENDRY, being able or
having the-capacity to so act, the successor trustee shall be GEORGE HENDRY-,
` brother of the trustee here and the son of the grantor to the-real property -
hereinabove set out, with the said successor trustee to act therein under
the same terms and conditions, without bond or other security for the best
benefit of the beneficiaries herein named.
That the trustee shall have the right but not the obligation, this
trust being discretionary, to terminate this -trust by transferring the title
to the real property, the subs ect of the trust, to one or all of the
beneficiaries under the trust. _
That this trust shall be administered in accordance with the laws
of the State of Florida unless and except all of the surviving beneficiaries
live outside of the State of-Florida and in which event, the said beneficiary -
