And the Court having the benefit of the evidence presented and
the argument of counsel for the parties, P~aintiff and Defendant;
and the Court upon consideration thereof, being advised of its
judgment-in the pxemises, finds that-the Plaintiff, PERSONALIZED
CLEANING-AND MAINTENANCE SERVICE, INC., has failed to~sustain
the material allegations of the Complaint by the testimony and
.proof offered and taken in itsTbehalf, and that the Defendant
has asserted and proven affirmative d~_fenses so that the
Plaintiff is not entitled to the relief sought by its Complaint,
nor to any relief thereunder, and-that the equities~of this
cause are with the Defendant, RICHARD DERVIN d/b/a ABRA CLEANING
~ MAINTENANCE SERVICE. It is the further finding of this Court
that the Defendant, RICHARD DERVIN d/b/a ABRA CLEANING_&
MAINTENANCE SERVICE, is entitled to its taxable costs in the

i ~ It is therefore,
ORDERED AND ADJUDGED as follows:
1. That the said Complaint be and the same is hereby
dismissed; -
2. That the temporary-injunction issued in this cause
on April 20, 1979, be and the same is hereby dissolved; it is

E FURTHER ORDERED AND ADJUDGED that the injtinction~bond hereto-

} fore filed in this- cause continue -in full force and effect, aid
that the Court retains jurisdiction of the parties for the
purpose of holding additional hearings to determine and .establish
such damages as may be-found to be-due the Defendant, RICHARD
DERVIN d/b/a ABRA CLEANING & MAINTENANCE SERVICE, from the -
lj Plaintiff, resulting from the issuance of the temporary injunc-
tion, and it is,
FURTHER ORDERED AND ADJUDGED that the Defendant, RICHARD
