4. Venue of this proceeding is in this County because the
Decedent died in Saint Lucie County and at the time of his death was
domiciled in Saint Lucie County, Florida.
5. ROBERT L. TOYS, whose address is 2302 South Nineteenth
Street; Fort Pierce, Florida, 33450, and who is qualified under the
laws of the State of Florida to serve as Personal Representative of
the Decedent's estate is entitled to preference in appointment as
Personal Representative because the .Petitioner was appointed as a
Co-Personal Representative by the Decedent in the Decedent's Last Will -
And Testament and the Petitioner is entitled to serve as Personal
Representative of rthe. Decedent's estate due to the Waiver And Renun-
ciation Of Right To Serve As Personal Representative filed herein by
NANCY MARIE THOMAS in favor of the Petitioner, said Waiver And Renun-
- ciation being incorporated herein and made a part hereof by reference.
6. The nature and approximate value of the assets in this
~ estate are shares of stock, bonds and the like which have an approxi-
mate value in excess of $20,000.00.
7. Petitioner is unaware of any unrevoked will or codicil
of Decedent other than as set forth in paragraph 8.
8. The original of the Decedent's Last Will dated March 26,
1976, accompanies this Petition and is made a part hereof.
9. -Petitioner requests that the Decedent's Will be admitted -
to probate and that ROBERT L. TOYE be appointed Personal Representative
of the Florida estate of the Decedent.
