CONSENT TO LIEN AND DECLARATION OF INTEREST IN MORTGAGE _
WHEREAS,~RIVERHOUSE CORP., a Florida corporation,
- (hereinafter referred to as Mortgagor) is plaintiff in a
certain suit in the'Circuit Court of the Nineteenth Judicial -
District in and for St. Lucie County, Florida, designated as
Civil Action No: 78-558 and FORT PIERCE HOTEL, INC., a
Florida corporation, and FRANCIS W. FENNIMORE, (hereinafter
~ referred to as Mortgagees) are defendants in that suit and
WHEREAS, a final judgment as to the issue of liability
has been rendered in favor of Mortgagor and
InIE~EREAS, Mortgagees have appealed that judgment and
wish a stay pending review of said judgment and
WHEREAS, Mortgagor wishes security in regard to the
stay rit is hereby agreed as follows:
1_. Mortgagees consent to a lien on a certain mortgage
given by Mortgagor to Mortgagees dated April 7, 1978 and -
recorded May 17, 1978 in O.R. Book 287, page 525 of the public
_ -records of St. Lucie County, Florida in the original principal:
amount-of $237,500.00 in favor of mortgagor.
2. It is understood and agreed between the parties
that this lien secures the interest of Mortgagor as to any
amounts that may become due and owing by Mortgagees to

t~ortgagor after a final adjudication of the above mentioned
law suit.
3. Mortgagor agrees that in the event of a
satisfaction of ary final judgment rendered in the above
mentioned law suit or in the event that a final determination
of that cause shows no amount due Mort a or, Mortgagor agrees

to execute such documents to release this lien.
