Profit Sharing Trust hereinafter called the Mortgagor, and Dr. Alfred H. Kennemer, hereinafter called the Mortgagee. (The term "Mortgagor" and "Mortgagee", as used in every instance shall include their heirs, executors, ad- ministrators, successors, legal representatives and assigns, either voluntary by act of the parties, or involuntary by operation of law and shall denote the singular and (or) plural, and the masculine and (or) feminine and natural and (or) artificial persons, whenever and wherever the context so requires or admits.) WITNESSETH, That for divers good and valuable considerations, and also to secure the payment of the sum of money set ~ forth in the promissory note of even date herewith, hereinafter described, the Mortgagor does grant, bargain, sell, alien, r e remise, release, convey and confirm unto the Mortgagee, in tee simple, tine Toiiowing described real estate, u+ wi+iu+ i+.e ~ Mortgagor is now seized and possessed and in actual possession, to-wit: U O m The North 150 feet of Government Lots 1,2 and 3, of Section 3; and that part of 3 the North 150 feet of Government Lot 1, Section 4, Township 34 South, Range 40 East, which lies due West of the above-described real property, St. Lucie County, Florida. AND Lot 25 of KANSAS CITY COLONY, according to the Plat thereof, recorded in Plat r Book 4 at Page 23, of the Public Records of St. Lucie County, Florida. Said lands situate, lying and being in Indian River County, Florida. N TOGETHER with a!I structures and improvements npw and hereafter erected on said land and fixtures attached thereto, c o and all easements, rights, appurtenances, rents, issues, proceeds and profits accruing and to accrue from said property, all of G ~shich are included within the foregoing description and the habendum hereof. Also all gas, steam, electric, water and other - heating, air conditioning, cooking, refrigerating, lighting, plumbing, ventilating, irrigating, and power systems, machines, appliances, fixtures and appurtenances, which now are or may hereafter pertain to or be used with, in or on said premises, even though they be detached or detachable. TO HAVE AND TO HOLD the same, together with the tenements, hereditaments and appurtenances, unto the ~ Mortgagee, in fee simple. .PROVIDED ALWAYS, that ii the Mortgagor shall pay unto the Mortgagee the indebtedness evidenced by that certain ? promissory note, of even date herewith, made by the Mortgagor and payable in installments to the Mortgagee, in the principal sum of Seventy Four Thousand Five Hundred Fift No/100 Dollars r (S 4,550.00 together with interest as therein stated, and shall perform, comply with and abide by each and every the stipulations, agreements, conditions and covenants contained and set forth in this mortgage and in the promissory note secured hereby, then this mortgage and the estate hereby created shall cease and be null and void. ~ AND the Mortgagor does hereby covenant and-ogee to all the terms, conditions, representations and warranties set forth w in the exhibit entitled "Covenants", which is attached hereto and made a part hereof.
