Court having heard argument of counsel and having considered
memorandum submitted by Defendant, (Plaintiff having failed
to submit a memorandum), upon due consideration, the Court
finds that Plaintiff filed a motion for default for failure
of Defendant to file an answer, and it appearing~an answer by
Defendant was filed the day before this hearing, Plaintiff's
motion for default as to Count I is denied. R.C.P. 1.500.
