This action was tried before the court without the
intervention of a jury. On the evidence presented, and
counsels for Plaintiff and Defendant having filed a Memoranda
of Law in regard to the allowance of interest and the
Defendant having failed to show any law or authority which
requires interest to be proven at trial and the court being

fully advised in the premises, it is;
ORDERED AND ADJUDGED that the Plaintiff, HOYT C. MURPHY,
INC., REALTORS, have and recover from the Defendant, AL

DiVAGNO the sum of $30,000.00 plus interest of $3,750.00 plus
~ its costs to be taxed 'by special order of the court .
DONE AND ORDERED in Chambers at Fort Pierce, St. Lucie
