O_R_D_E_R_
THIS CAUSE having come on to be heard upon the Petition
for Writ of Habeas Corpus, Response thereto and Reply to said Response,
and the court having heard the testimony of the following witnesses,
to-wit: Respondent, Larry W. Vining, Petitioner, Margaret Yvette
Vining, Martha Vining Henderson, Evelyn Vining and Tim Vining, and
arguments of counsel and being otherwise fully advised in the
premises, it is:
ORDERED AND ADJUDGED AS FOLLOWS:

1. That the request of the Respondent to dismiss the
r Writ of Habeas Corpus be and the same is hereby denied.
2. That the petition for the Writ of Habeas Corpus be
~ and the same is hereby granted.

~ 3. That temporary custody be and the same is hereby given
immediately of the minor children known as DORCIA VINING and THYRA
VINING to the Petitioner, MARGARET YVETTE VINING, their natural
mother; upon the condition that prior to exercising said temporary
custody, the Petitioner must post with the Clerk of this Court a cash
or surety bond in the amount of $5,000.00, said surety bond to be
executed by a surety licensed in the State of Florida, in order to
insure the presence of said minor children at any future time as is
deemed appropriate by order of this court.
DONE AND ORDERED this ~ day of October, 1979, in Fort
Pierce, St. Lucie County, State of Florida.
