The decedent was a widow who owned a homestead described as:
Lot 2, of GOWDY'S SUBDIVISION, as recorded
in Plat Book 4, Page 8, of the Public
Records of St. Lucie County, Florida.
where she lived with her son, JOHN RICHARD SWILLING, Inco~apetent, and
the decedent was the head of the household, therefore, said homestead
passes by operation of law to the decedent's son, JOHN RICHARD SWILLING,
and said property is not subject to administration in this estate.
6. The estate is not indebted except for:

It is proposed that the above debts be paid out of the cash ~
that is in the decedent's account in the Florida Bank which is
sufficient to pay all of said debts.
7. It is proposed that all probate assets of the decedent,
including exempt property, be distributed or disposed of as follows:

8. Petitioner is unaware of any unrevoked will or codicil of
decedent other than as set forth in paragraph 9. r
9. The original of the decedent's last will, dated January 4,
1963, witnessed by Nancy J. McDonald, Gertrude Bohren and C. R. f
McDonald, Jr., is in the possession of the above court or accompanies
this petition.
10. Decedent's will does not direct administration as required
by Chapter 733, Florida Statutes.
Petitioner requests that the decedent's last will be admitted
into probate and an order of family administration be entered directing
distribution of the assets in the estate in accordance with the
schedule set forth in paragraph ? of this petition.
