ORDER ON PRE-TRIAL CONFERENCE
After due notice by or to all parties affected, a Pre-Trial
Conference was held on October 4, 1979. It is,
ORDERED AND ADJUDGED:
1. STIPULATION AND ADMISSIONS were made as follows:
The parties were unable to agree on any stipulation or
admissions at the Pre-Trial Conference, but the Plaintiff had
previously filed a Request for Admission of. Fact on October 31,
1978, which was not answered and consequently the Court deems
those requests to have been admitted.
2. EVIDENCE: Documentary and other evidence listed
on the parties .Pre-Trial Statements and presented to opposing
counsel shall be admitted into evidence without objection
except as to relevance and materiality.
3. OTHER PROVISIONS: The Defendants, by and through
their counsel, at the time of Pre-Trial Conference, made an
oral Motion to Amend the Answer previously filed herein, and
to continue the trial. The Court having heard the argument
on the Motions denies the Motion for a continuance, but shall
permit the Defendants to file an Amended Answer on or before
October 8, 1979. Additionally, the Defendants shall file a
written Pre-Trial Statement on or before October 8, 1979 and
the attorneys for the parties shall have a preliminary con-
ference and exchange Pre-Trial Statements prior thereto.
