ROKAW Husband O R D E R A final judgment dissolving the marriage was entered on the 24th day of July, 1979. It provided for lump swn alimony in paragraph four to be paid in .the amount of $375. commencing. on the 1st day of August, 1979, and payable each and every month until the total of $27,000. be paid. On August 6, 1979, a ~ Motion and Notice of Hearing were filed for an order to find ALLAN E. ROKAW to be in contempt of the terms of the final judgment. An amended judgment dissolving the marriage was filed on the 13th day of September, 1979, and a Motion and Notice of Hearing for an order adjudging the former husband to be in contempt of the amended final judgment was filed September 19, 1979, and heard on the Sth day of October, 1979. After hearing testimony and arguments of counsel, ALLAN E. ROKAW, husband, is found to be in contempt of court for his wilful failure to comply with the terms of the final judgment. This final judgment of divorce is itself a finding that, as of the moment of its entry, Mr. Rokaw had the ability to make the required payments. As against such a decree he will not be heard to say he could not comply at the time of the entry of the final decree. There has been no showing of any change in financial circumstances.
