NOW, THEREFORE, it is hereby agreed by and between the
parties hereto that the promissory note from Mortgagor to Mortgagee,
secured by mortgage dated Aigist 22, 1974, and recorded in 0. R. Book
231, Pages 2063, 2064, and 2065, of the Public Records of St. Lucie
County, Florida, is modified as follows:
(1) Where said promissory note provides "the final payment
being a bolloon payment in the amount ~f $22,757.42, including interest
at the rate of lO.Ox", the same is hereby amended to read: "That with
a principal balance of $22,007.07, there will be 59 equal installments of
$500.82, including interest, with a 60th and final payment of remaining
principal plus interest due on September 1, 1984, also the first
monthly instalment of $500.82 be due on November 1, 1979.
(2) It is further agreed that said note shall further provide
that on and after the 1st day of October, 1979, it shall bear interest
at the rate of 13.Ox per annum on the unpaid balance until maturity.
(3) And it is further agreed by the party hereto that said
promissory note shall be further modified to read and include the following:
A late charge of $25.04 shall be added to each installment
remaining unpaid seven (7) days after its due date, which
sum shall be added to each and every installment which
remains unpaid seven (7) days after the due date of
t each suceeding installment.
(4) Except as herein expressly amended, modified and changed,
the terms of said note and mortgage are hereby ratified, approved and
