This cause came before the court upon Plaintiff's
motion to strike Defendant's pleadings and to enter default
against Defendant. Upon consideration thereof, the court
finds:
1. Defendant, SPIRIT OF AMERICA, INC., has repeatedly
refused or neglected to respond to discovery or to appear for
deposition to this cause.
2. This court entered its order compelling discovery
on 22 May, 1979, which order Defendant has failed to obey.
ORDEREt~ that all responsive pleadings filed herein by
Defendant, SPIRIT OF AMERICA, INC., a Florida Corporation, are
hereby stricken and a default is entered against said Defendant,
SPIRIT OF AMERICA, INC.
