' Petitioner, MARIAN V. HUNGER, the duly appointed
Executrix of the Estate of HARLAND A. SMITH, deceased, alleges;
1. AARLAND A. SMITH died on December 9th, 1978 at
. Arnold Gregory Memorial Hospital, Albion, New York, leaving a
Last Will dated August 30th, 1978, duly executed by the testator
in the presence of three subscribing witnesses and he was over
eighteen years of age and a Codicil dated December-8th, 1978
y duly-executed by the testator in the presence of three sub-
scribing witnesses and he was over eighteen years of age.
' - - 2. The decedent at the time of his death was domiciled

in Orleans County, New York, and owned certain property in the
State of Florida consisting of real property situated in

Charlotte County, Florida, and in Indian River County, Florida,

and in St. Lucie County, Florida, having a value in excess of

$35,000.00.

3. The Will and the Codicil of the decedent was duly
admitted to probate and record in the Orleans County Surrogate's
Court by~order dated December 12th, 1978, that Court having

x probate jurisdiction at the domicile of the decedent.
