SMITH, deceased, alleges; 1. AARLAND A. SMITH died on December 9th, 1978 at . Arnold Gregory Memorial Hospital, Albion, New York, leaving a Last Will dated August 30th, 1978, duly executed by the testator in the presence of three subscribing witnesses and he was over eighteen years of age and a Codicil dated December-8th, 1978 y duly-executed by the testator in the presence of three sub- scribing witnesses and he was over eighteen years of age. The decedent at the time of his death was domiciled - ~ in Orleans County, New York, and owned certain property in the State of Florida consisting of real property situated in I Charlotte County, Florida, and in Indian River County, Florida, I and in St. Lucie County, Florida, having a value in excess of p ya k $35,000.00. k 3. The Will and the Codicil of the decedent was duly admitted to probate and record in the Orleans County Surrogate's Court by~order dated December 12th, 1978, that Court having t x probate jurisdiction at the domicile of the decedent. ~ ~ 4.
