The Plaintiff s attorney fee in that action is forty percent and the costs are $1,000. Applying the formula of National Ben • Franklin Ins . Co , v . Hall, • Liberty 114utual Insurance Company's pro rata share of the $50,000 settlement is calculated as follows: .58 X .20 X $74,094 = $8,594.90. IT IS THEREFORE ADJUDGED THAT: r 1. The Plaintiff shall pay Liberty Mutual Insurance Company $8 , 584.90 as its pro rata share of the $50, 000 settlement entered into by the Plaintiff and Defendant in the above captioned matter .
