HomeMy WebLinkAbout0166 79 516 G~ NINTH: I name my wife, BEATRICE H. MILLER, as Executrix of this Will. If~she fails or ceases to serve, I name my sons, LEE A. MILLER and RICHARD A. MILLER, or the survivor of them, as Contingent Executors hereof. I direct that no bond shall be required of either of the foregoing while serving as my personal representative. TENTH: In addition to and not in limitation of the powers and discretions granted by rule of law or by statute, I give to my personal representative or to its successor, the following powers and discretions, in each case to be exercisable without C©urt Order: - (a) To sell or otherwise dispose of any property, real or personal, at any time forming a part of my estate, for cash or upon credit, in such manner and on such terms and conditions as my personal representative may deem best; (b) To manage, operate, repair, improve, mortgage and lease for any term any real estate at any time held by it; (c) To compromise, settle or adjust any claim or demand by or against my estate; (d) To make distribution in cash or kind upon any - division of my estate; (e) In general, to exercise all powers in the manage- ment of my estate which any individual could exercise in the management of similar property owned in his own right, upon such terms and conditions-as may .seem best to my personal representative, and to execute and deliver any and all instruments and to do all acts which may be deemed necessary or proper to carry out the purposes of this Will. I have signed this Will consisting of five .typewritten pages on the bottom of each of which I have signed my nab for gre ter security and better identification on this ~c`L~ day of /tr I9 7 3 .
