IN RE: THE MARRIAGE OF
DONALD E. YAWN, Husband
and
BARBARA A. YAWN, Wife
O R D E R
This cause came on to be heard on September 25, 1979 on
the Husband's Motion to Modify Final Judgment and the Court having
heard testimony of the respective parties and argument of counsel
and being fully advised in the premises,- it is thereupon
ORDERED AND ADJUDGED as follows:
1. That the Motion to continue the cause filed by
the Wife, Barbara A. Yawn, be and the same is hereby denied.
2. That-the Motion filed by the Husband, Donald E.
i Yawn, to Modify the Final Judgment be and the same is hereby denied.
j 3. That paragraph 4 of the Final Judgment entered in
this cause~on February 9, 197-9 be modified to read as follows:
"4. DISPOSITION OF REAL PROPERTY: The Wife and
the minor children shall have the right to the use
and possession of the marital dwelling and the con-
tents thereof until the youngest of the minor children
reaches eighteen years of age; said home is located at
1003 Martinique Avenue, Fort Pierce, Florida and is
legally described as follows:
Lot 2, Block K, Maravilla Estates,
according to the plat thereof as
• recorded in Plat Book 8 at page 77
of the public records of St. Lucie
County, Florida.
The above described property is encumbered presently by
a mortgage to the Atico Mortgage Company and as a form ,
of child support completely separate from the monetary
F' child support provision in paragraph 3 above-the
Husband is hereby ordered to make all mortgage payments
each and every month to Atico Mortgage Company, now
known as Advance Mortgage Company, removing said
obligation of making the mortgage payments from the
Wife until the youngest minor child reaches the age
of eighteen years of age at which time the Husband and
the Wife will each be responsible for one-half of the ~
mortgage payments. From the date of this order forward
