HERMAN TOLBERT,
Respondent.
THIS CAUSE was heard on October 22, 1979, upon the Motion for
Enforcement and Contempt previously filed herein by the Petitioner, and the
Respondent having been present in open court in person, and the Petitioner
having been present in open court in person and represented by counsel, and
the Court having heard all of the testimony of the parties and being fully
advised in the premises, it is therefore
ADJUDGED that the Respondent, HERMAN TOLBERT, is guilty of willful
contempt of this Court for failure to pay child support payments in the amount
of $2,635.00, (amount due as of October 5, 1979) and he is adjudged in contempt
of this Court and it is
ORDERED AND ADJUDGED that the Respondent, HERMAN TOLBERT may purge •
himself by promptly paying $25.00 on the arrearage in the amount of $2,635.00
to the Clerk of the above .entitled Court, together with the statutory cost of
$2.00 which shall be added to each payment, on October 30, 1979, and another like
payment each week thereafter until said $2,635.00 is fully paid. The payment of
$25.00 per week on the arrearage shall be in addition to the $25.00 per week as
provided by order of this Court and said payments shall continue. It is further
ORDERED AND ADJUDGED that if the Respondent does not keep current
the payments as set forth above for 60 days from the date of this order the
Respondent HERMAN TOLBERT shall be confined in the St. Lucie County Jail, Fort _
Pierce, Florida, for a period of 30 days. Upon the failure of the above-named
Respondent to make payments of the aforesaid amounts within 60 days of the date
of this order, you and your duly authorized deputies are therefore and
ALL AND SINGULAR OF THE SHERIFFS OF THE STATE OF FLORIDA are ordered
to take into custody the above-named Respondent as soon as he can be found and
deliver him to the Sheriff of St. Lucie. County, Florida, for the execution of the
above described judgment and sentence. The Clerk of Circuit Court and this Court
shall be promptly notified of his arrest. It is further
ORDERID AND ADJUDGED that the Clerk of Circuit Court shall and he is
hereby ordered to forward said arrearage payments received from the Respondent
until the above arrearage is paid in full to the Department of Health and
Rehabilitative Services, Child Support Enforcement Section, 1317 Winewood Boulevard,
Tallahassee, Florida, 32304.
DONE AND ORDERED at Fort Pierce, St. Lucie County, Florida, on this
23rd day of October, 1979.
