GEORGE T. ARGYRIS, risiding at 6 Cornwall Court, Oakland,
California, being duly sworn, deposes and says:
1. I am a member in good standing of the State Bar of
California and practice in the fields of estate planning, probate
and trust law.
2. I am familiar with the Probate Code of the State of
California which, in general, governs the creation and administra-
tion of wills, trusts and administration of decedents' estates.
3. I have reviewed the provisions of the Vivian Vance Dodds
Real Property Trust, under Declaration of Trust dated August 8, 1979,
by and between Vivian Vance Dodds as Trustor, and John R. Dodds as
Trustee, pursuant to which, under the provisions of Article III,
the Trustee is granted, in addition to all other powers conferred
by the Agreement, all powers enumerated in California Probate
i
Code Section 1120.2.
4. Section 1120.2(1) of the California Probate Code
provides for the following powers:
. "(1) To manage, control, sell, convey, divide and
to sell upon deferred payments; to lease for terms
within or extending beyond the duration of the trust
for any purpose including exploration for and removal
of gas, oil or other minerals; to enter into community
oil leases."
5. Subparagraph (1) of Probate Code Section 1120.2,
quoted above, specifically refers to the power to manage, control,
sell, convey, divide, and to sell upon deferred payments.
