ASSIGNMENT
THIS ASSIGNMENT made this ~S~T day of October, 1979,
by SYBIL LEVITA CULVERHOUSE, individually; SYBIL LEVITA
CULVERHOUSE, as Trustee under the Last Will and Testament of
B. A. BROWN, Deceased; GEORGE H. CULVERHOUSE, J R. and IRENE
CULVERHOUSE, his wife; and JOHN BRADFORD CULVERHOUSE,
hereinafter referred to as Assignors, to INDRIO GROVES, INC.,
hereinafter referred to as Assignee.
W I T N E S S E T H_
WHEREAS, Grantors previously demised unto JOHN MERK the
following described lands in St. Lucie County, Florida:
The NW 1/4 of the NW 1/4 of Section 25, and the SW 1/4
of the SW 1/4, NW 1/4 of SW 1/4 and SW 1/4 of NW 1/4 of
Section 24, all in Township 34 South, Range 38 East
All as more particularly set forth in that certain Lease
dated October 16, 1963 and recorded in Official Record Book
72 at Page 645 of the Public Records of St. Lucie County,
Florida, which lease as modified is hereinafter referred to
as the "lase"; and
~ WHEREAS, the said JOHN MERK has exercised the option to
I purchase the above-described land in accordance with the
terms and provisions of the lease; and
1 WHEREAS, paragraph eleven of the Lease provides as

11. In the event Lessee exercises his option to
purchase hereinabove provided for, Lessors shall
permanently set over, assign or allot to~Lessee, his
heirs, successors or assigns, 12,000 gallons per minute
pumping capacity into the canal on the West boundary of
Lessee's property referred to as the "Minute Maid Canal"
from the total pumping capacity granted to Lessors by
the Central and Southern Florida Flood Control District,

and shall execute all documents necessary or required by
said Flood Control District to accomplish said purpose,
and Lessors further agree that during the term of this
Lease they shall not set over, assign or allot to any
person, firm or corporation said 12,000 gallons per
minute pumping capacity and shall, during the term of
this Lease, always reserve said amount of pumping
capacity for Lessee from the total pumping capacity now
~ alloted to Lessors by said Flood Control District.
