FAILURE TO PROSECUTE AND FOR EXTENSION OF
TIME WITHIN WHICH TO AMEND COUNTERCLAIM
THIS CAUSE having come on for hearing before the Court on
Defendant/Counterclaimant, HANSON DREDGING, INC.'s, Motion to Dismiss
Plaintiff's Amended Complaint for Failure to Prosecute and upon Plain- '
tiff/Counterdefendant, CAPELETTI BROTHERS, INC.'s, ore tenus request
that the Court rule upon Defendant's Motion for Extension of Time
within which to amend its Counterclaim, which request was considered
without objection on the part of Defendant, and the Court, having

heard argument of counsel and being otherwise fully advised in the
premises, does
ORDER and ADJUDGE as follows:
~ 1. The Court reserves ruling upon Defendant's Motion to Dis-
miss for Lack of Prosecution. Plaintiff is to submit a Brief on this
~ issue and on the points raised by the Court at the Hearing of October 23,
1979 within thirty (30) days from the date of this Order. Defendant
shall have twenty (20) days from. the receipt of Plaintiff's Brief to
file and serve its Brief on said issues, and Plaintiff shall file and
- serve any reply Brief to Defendant's Brief within ten (10) days from
s its receipt of Defendant's Brief.
2. Defendant's Motion for Extension of time within which to
amend its Counterclaim and Defendant/Counterplaintiff shall file and
serve its Amended Counterclaim within thirty (30) days from the date of
this Order.
