VII HOMESTEAD The Court finds that the parties have bought a homestead located at 12426 Boheme, Houston, Texas. 77024, and that the following Orders should issue with respect thereto: Wife and the children will continue living in their home on 12426 Boheme, Houston, Texas. As set out herein in Paragraph V, (c), this property shall be set aside, apportioned and awarded to Wife as her sole and separate property and estate, however, in recognition of Husband's continuing liability under the promissory note and Deed of Trust given by Husband and Wifz in connection with t'~e purchase of said house and Iot, Husband shall Zot be requ~.r2d to convey title to Wife until his lia- b_lity under .he aforesaid promissory note and Deed of Trust shall ::ave been discharged absolutely; and further provided that in the event Wife arranges ~ sale of the aforesaid house and lot on an assumption basis, and the holder of the aforesaid promissory note and the trustee and beneficiary under the aforesaid Deed of Trust approves of such sale, then and in such event, upon demand of Wife, Husband shall join in any conveyance necessary to effectuate such sale, provided further that Husband is made a beneficiary of a Deed of Trust to Secure Assumption to be executed by any such purchaser.
