(A) Before submission, the Mortgagor shall first submit to the Mortgagee and shall obtain the Mortgagee's prior written approval to the following: (i) a description of the portion of the premises intended to be submitted to the provisions of the Con- dominium Act, all in such detail as the Mortgagee shall reason- ably require (each such portion, a "i.Ulluc~ttti,iiuSi" % ; :;aa°au, (ii) a detailed description of the number, size and location of all of the units (each a "Unit" and all or more than one the "Units") to be submitted to the Condominium Act, of all of the appliances, fixtures, furniture and furnish- ings to be included with each such Unit, of all recreational and other facilities available to each such Unit, and of all of the common elements to be included in the Condominium. (iii) the forms of declaration, by-laws, floor plans and all other documents to be recorded, filed or otherwise utilized in the creation of the Condominium; (iv) a copy of the offering plan for the Condominium together with all exhibits and other materials to be submitted to the Department of Business Regulation, Division of Florida Land Sales and Condominiums in connection with the request for approval to offer for sale the Units. (v) a copy of the proposed budget for the first full year of operation of the Condominium prepared in accordance with the requirements of the Condominium Act and all regulations promulgated thereunder; and (vi1 -such other or further documents, data or information with respect to the creation of the Con- dominium or the initial operation thereof as the Mortgagee may reasonably request. L 1 1 tL, flw ...L..-.. /YY ~1n 011!1 (13) In nU CVCIlI, ~11n11 :.yu7::~ modify or supplement any of the documents specified in Paragraph (A) above, either before or after the submission of -the premises or any portion thereof to the provisions of the Condominium Act, after they have been approved by the Mortgagee unless the Mortgagor shall first have obtained the written consent of the Mortgagee to such amendment, modification or supplement. (C) The Mortgagor will faithfully and dili- gently make and carry out all reasonable efforts to properly submit such portion of the premises to the provisions of the Condominium Act, and will comply fully with all applicable provisions of the Condominium Act, with all requirements of the Department of Business Regulation, Division of Florida Land Sales and Condominiums and with all other legal requirements of all federal, state and local authorities, regulations and orders of any state in which an offering of Units is made. -2- 319 ~a~E 205 ~ - d7~1~
