The fourth paragraph in Article II, subparagraph 12 is hereby amended to read as follows: The monthly charges shall become due and payable at such time or times as the Association may determine and shall become a lien on the lot, dwelling unit or other Parcel of the Property when a claim of lien therefor is recorded in the Public Records of St. Lucie County, Florida. Reasonable attorney's fees incurred by the Asso- ciation incident to the collection of such assess- ment or the enforcement of such lien, together with sums advanced and paid by the Association in order to preserve and protect its lien, shall be savable by the lot, unit or parcel owner, as the~case may be, upon demand and shall be secured by such a lien. 2. Article II, paragraph 12 is hereby amended by adding the following additional paragraphs thereto: Where the holder of an institutional mortgage of record, or other purchaser of a lot, dwelling unit or other Parcel of the Property, obtains title to said lot, unit or Parcel as a result of foreclosure or the institutional mortgagee of record accepts a deed in lieu of foreclosure, such acquirer of title, its successors and assigns, shall not be liable for the share of assessments by the Property Owners' Association pertaining to such lot, unit or Parcel, or chargeable to the former owner of such lot, unit or Parcel, which became due prior to acquisition of title as a ~ result of the foreclosure, or the acceptance of such deed in lieu of foreclosure unless the share is secured by a claim of lien recorded prior to the recording of said mortgage. Any person who acquires an interest in a lot, ~ unit or Parcel of the Property (except through ~ foreclosure of an institutional mortgage of record or deed in lieu thereof as specifically provided in the paragraph immediately preceding) including, without limitation, persons acquiring title by operation of law, such as purchasers at judicial sales shall not be entitled to occupancy of the lot, unit or Parcel, until such time as all unpaid Property Owners' Association assessments due and owing by the former owner have been paid. 3. Article III, paragraph 5 is amended by changing the third typewritten line in the first paragraph thereof to read as follows: ...by recording in the Public Records of St. Lucie County, Florida.... -2- ~~~X~~ Q~~ I ~7~
