Makers when it shall have been deposited in the United States
Certified Mails, with sufficient prepaid postage thereon to carry
it to its addressed destination, addressed to the Makers at the
address of Makers hereinbelow stated; .regardless of whether tree
Makers actually receive delivery of said notice.
The i?lakers and all endorsers and guarantors of
this Note hereby waive demand, presentment, notice of non-payment,
dishonor-and protest, and agree in case suit shall be brought for
the collection hereof, or it is necessary to place the same in the
hands of an attorney for collection, to pay all costs and reasonable
attorney's fees incurred by the holder hereof in prosecuting or
resisting any proceedings_in all appellate courts before or after
final decision of a court of competent jurisdiction arising out of
any action to collect, enforce, or defend the within Note, the
Security Agreement securing the within Note, and any and all other
instruments, agreements, liens, or assignments executed in connection
with the within Note.
The Note is secured by a-Conditional Sales Contract
and Security Agreement ('The Security Agreement') executed under
date hereof, by the Makers, as Debtors, unto the Payee or Holder,
as Secured Party. The contents of said Security Agreement are
incorporated by reference in this Note and all persons to whom these
presents may-come are referred to said Security Agreement for the
provisions thereof and their effect upon the within Note. A default
in the performance of any of the obligations of the Makers (Debtors)
in the terms of the aforementioned Security Agreement shall have
the same effect as a default in the payment of any monthly instalment
of interest and principal required to be made under the terms of this
Note .
Nothing contained herein shall be construed as making
it obligatory upon the Payee or Holder to follow any particular course
of action or to pursue any particular remedy in advance of any other or
others accruing to the Payee or Holder upon the occasion of the default
in the payment of the within Note.
