THIS CAUSE came on for consideration upon all pending
motions and this Court having considered the arguments and stipula-
tions of counsel and being otherwise fully advised in the premises
it is
ORDERED AND ADJUDGED that Defendants' Motions to Quash
service of process are denied as .they have been withdrawn by the
Defendants pursuant to stipulation of the parties in open Court
and it is
ORDERED AND ADJUDGED that Plaintiff's Motions to Compel
are granted and the Defendants have 30 days to respond to
Plaintiff's Interrogatories and further that Defendants Ashton and
Brooks will submit to deposition by Plaintiff upon proper Notice of
Taking Deposition and it is
ORDERED AND ADJUDGED that Defendants' Motion to Dismiss
Plaintiff's Amended Complaint is granted as to Count 3 and Count 5
and as to the liable portion of Count 6. The Court reserves ruling
as to Count 4. Defendants' Motions to Strike are granted as to
the prayers for attorneys' fees contained in the Amended Complaint.
In all other respects, Defendants' Motions to Dismiss and Motions
to Strike are denied and it is
ORDEREb AND ADJUDGED that defense counsel may have l0 days
to submit a Memorandum of Law concerning the issue of lost wages
as an element of damages and the assessment of punitive damages
against an insurance carrier. Plaintiff shall have 10 days to file
a responsive Memorandum and it is
