AFFIDAVIT

Before me the undersigned authority duly authorized to take
acknowledgments in the State and County aforesaid, personally appeared Joy P
Cushman who upon being duly sworn deposes and says:
Affiant is the owner of that Easement dated February 12, 1974,
between Edenlawn Plantation, Inc, a Florida corporation and A D Merwin, a
single man, individually to Joy P Cushman, recorded in the OR Book 223, page
2704, public records, St LUcie County, Florida.
At the time the easement dated February 12, 1974, was prepared and
executed, it was with the intentionlhat the Affiant might someday desire to
develop those lands owned by the Affiant West of the FEC railroad tracks
immediately North of and adjacent to Edenlawn Plantation.
The easement was granted with the clear intention of all parties
that should Affiant ever desire to cross the FEC railroad tracks, Affiant would
have to apply to the. FEC for the right to do so as a separate and independent
matter.
The easement has never been used by the Affiant.
Affiant further states that the easement is now terminated by
Quit-Claim Deed, copy attached as Exhibit "A".
