ORDER
THIS CAUSE coming on to be heard upon the Defendant's Motion
for Summary Judgment/Judgment on the Pleadings, and upon the
argument of counsel, the taking of testimony, and the Court finding
that the Defendant has failed to carry the very heavy burden of
proving that there is no genuine issue as to any material fact, and
upon the Court further finding that there do presently exist material
factual disputes based upon the allegations in the pleadings, and
upon the Court being otherwise fully advised in the premises,' it is
ORDERED AND ADJUDGED that the Defendant's Motion for Summary
Judgment/Judgment on the Pleadings is denied.
