PHILLIPS, JR., erelnafter called the Grantor, to WILLIAM PHILLIPS, as to an undivided one-half (1/2) interest and ANNE PYKE, as to an undivided one-half (1/2) interest, ' whose post office address is c/o Cowen and Cowen, 1350 Avenue of America, New York City, NY 10019, hereinafter called the Grantee: (Wherever used herein the terms "grantor" and "grantee" include all the parties to this instru- ment and the heirs, legal representatives and assigns of individuals, and the successors and assigns of corporations.) W I T N E S S E T H WHEREAS, WALTER PHILLIPS a/k/a WALTER T. PHILLIPS, by virtue of that certain Warranty Deed given by Stewart B. t Iglehart, et al, dated March 12, 1959 and recorded in Deed. Book 249 at Page 246, Public Records of St. Lucie County, Florida acquired title to a certain tract of land in Sections 4 and 5 of ' - Township 37 South, Range 37 East in St. Lucie County, Florida, o ~ all as more particularly described in Schedule A attached hereto i and by reference made a part hereof (hereinafter referred to o ~ as the "Land"); and o r'`•'_ ~ WHEREAS, WALTER T. PHILLIPS departed this life on December 16, 1962 while a resident of the State of Florida leaving a surviving spouse, Dorothy F. Phillips, and three sur- i viving children, viz: the Grantor and Grantees herein; and WHEREAS, at the time of his death, the Land was the home- stead of the said Walter T. Phillips to the extent of 160 acres as provided in the constitution and laws of the State of S 1 Florida; and i E ~ WHEREAS, upon the death of said Walter T. Phillips, his ;-r ; surviving spouse became the owner of a life estate in his home- - stead property and his children became the owners of the remainder interest therein; and WHEREAS, the aforesaid Dorothy F. Phillips was the sole beneficiary under the Last Will and Testament of Walter T. Phillips, deceased; and WHEREAS, the aforesaid Dorothy F. Phillips conveyed all of - her interest in the Land to the Grantor herein by virtue of that certain Warranty Deed dated September 11, 1965 and recorded in .Official Record Book 143, Page 160, Public Records of St. Lucie County, Florida; and WHEREAS, Grantor and Grantees hereby agree that the North 80 acres of that portion of the Land situate in Section 4, Township 37 South, Range 37 East and the North 80 acres of that portion of the Land situate in Section 5, Township 37 South, Range 37 East, was the homestead of Walter T. Phillips, deceased, and Grantor and Grantees hereby designate said lands as the homestead of the said Walter T. Phillips, deceased; and WHEREAS, Grantor and Grantees now wish to make a physical division of the homestead property of the said Walter T.
