MORTGAGE DEED
T IS AR GAGE DEED, made and executed the
day of ~ s~ 19~, by LUCILLE V. Ct~ST~,
joined ~ e us an , A. COSTA, and JOSEPH McMAHON,
as Receiver for George A. Costa, et als, Debtors in Proceedings
•for Arrangement under Chapter XI of the Bankruptcy Act pending
in the United States District Court, District of New Jersey,
Case No. B-76-2704, by and through his attorney, BERNARD
BELSKY pu suant to Order of said Court dated the _~f day
of 1979, a copy of which is attac ed
beret as ii it hereinafter called the Mortgagors,
whic to and all pronouns used in connection therewith,
shall include the singular and the plural, the masculine
and the feminine, and the heirs, executors, administrators,
successors and assigns of the Mortgagors, whenever the
context so requires or admits to LIBERTY LIFE INSURANCE
COMPANY, a corporation organized and existing under and
by virtue of the laws of the State of South Carolina,
hereinafter called the Mortgagee, which term and all
pronouns used in connection therewith, shall include
the successors and assigns of the Mortgagee, whenever '
the context so requires or admits. '
WITNESSETH: That the Mortgagors, for valuable
considerations, hereinafter described, receipt whereof
is hereby acknowledged, do hereby grant, bargain, sell and
convey unto the Mortgagee, all of the certain piece, parcel
or tract of land, of which the Mortgagors are now seized
anc~ possessed and in actual possession, lying and being in
the County of St. Lucie, and State of Florida, more f
particularly described as follows:
Tract "B"; Lots 18 through 24, inclusive, Block }
3; and Lots 18 and 19, Block 2, together with
the North 10 feet of that 20 foot abandoned
alley immediately South and adjacent thereto;
all situated in CORAL COVE BEACH, SECTION ONE,
a subdivision according to the plat thereof
filed at Plat Book ll, Pages 30A and 30B,
Public Records of St. Lucie County, Florida;
and that part of Bimini Drive as shown on said
plat of CORAL COVE BEACH SECTION ONE, lying
Westerly of a Northerly extension of the West
line of Lot 17, Block 2, said CORAL COVE BEACH,
SECTION ONE, vacated as in O.R. Book 223,
Page 983, of the Public Records of St. Lucie
County, Florida.
THIS IS A SECOND MORTGAGE SUBJECT to and inferior
to the First Dlortgage lien in favor of First
National Bank of Fort Pierce.
SUBJECT TO taxes, easements, zoning and restrictions
of record.
together with all buildings and other structures now or -
hereafter upon said land, with the fixtures therein, and
all easements, tenements, hereditaments and appurtenances
thereunto belonging or anywise appertaining, and the
rents, uses and profits thereof, accruing to the Mortgagors, '
and its successors, and also all apparatus and fixtures now
or hereafter erected or. placed in or upon said real estate
or now or hereafter attached to or used in connection-with
said real estate, whether or not the same have or would
become part of said estate by attachment thereto, including
without in anywise limiting the generality of the foregoing,
all boilers, furnaces, heaters, stoves, ranges, oil burners,
mantels, gas and electric light fixtures, refrigerating
apparatus, ventilating or air condition system, elevators,
screens, screen .doors, awnings, blinds, window shades,
kitchen cabinets, floor coverings, lobby furnishings,
gas and oil tanks and equipment pipes, wires and plumbing,
all of which shall be considered as annexed to and forming
a part of the freehold thereby mortgaged.
