as to their/interest in a parL'nership trading as EAST RUTHEYFO&D
INDUSTP.IAL CENTER (hereinafter collectively called the "Assignors"
to .LIBERTY MIFF. INSURAt1CE C021PANY, a South Carolina Corporation
(hereinafter called the "Assignee").
t7~IEP~EAS, GEORGE A. COSTA and LUCILLE V. COSTA are
presently indebted to the Assignee, along with others, in accor-
dance and as a result of an original Promissory Note executed on
November 7, 1973, to The First National Bank of Fort Pierce,
Florida, which note was subsequently assigned to the Assignee
herein and which note is secured by a mortgage on Fronerty
located in North Beach, Fort Pierce, St. Lucie County, Florida;
and
- `.+~I?EREAS, a Forebearance and Modification Agreement
has been entered into by and ar.:ong tiie Assignors, Assignee, and
others; and
G)IiEREAS, the Assignors are presently entitled to
receive a portion of the proceeds of a condemnation award for -
certain New Jersey property in a matter now pending in the
Superior Court of New Jersey (Bergen County), Docket L-16799-72,
anti captioned: New Jersey Sports and Exposition Authority,
plaintiff, vs. various defendants, including East Rutherford
Industrial Center, a partners:~ip comprised majority of the
individual Assignors; and
[dHEREAS, said Assignors are debtors in a proceed- s

ing in the United States District Court for the District of
New Jersey, wherein a Plan of Arrangement is about to be con-

firmed or. dill be confirmed; and
