WE{EREAS, as a condition to such forbearance, Liberty
Life Insurance Company desires to be assured of the~fact
that in the event it ultimately enforces its mortgage lien
and other security interests as to the above-described real
property, it will continue to have uninterrupted water service
from North Beach ?Vater Company and has requested that North
Beach l~fater Company agree to provide such continued service; and
WHEREAS, North Beach 1~'ater Company as a public service
utility has a duty under the laws of the State of Florida and
regulations promulgated by the Public Service Commission of
the State of Florida to provide water service to those users
in its designated area so long as such users pay for same
-and as such has agreed to provide such continued service; and
WHEREAS, reliance by Liberty Life on such representa-
tions of continued service to the above-described real property
has in part induced Liberty Life to enter into the aforesaid
Forbearance agreement.
NOW, THEREFORE, be it agreed by the undersigned that
in consideration of the foregoing, TEN DOLLARS (10.00) and
other good and valuable considerations, receipt of-which are
Hereby acknowledged, George A. Costa d/b/a North Beach Water
Company a public utility regulated by the Public Service
' Commission of the State of Florida, hereby agrees as follows:
1. That in the event Liberty Life succeeds in
ownership or operation with respect to the above-described
real property, pursuant to the aforesaid Forbearance and
Alodification Agreement, Water Company shall continue to
provide water service to the above-described real property
in the same manner as al-1 other,~customers served by the utilit
and at the same rates authorized by the Public Service Commission,
so long as payments for such water service are timely made.
2. This Agreement-shall be binding upon and inure to
the benefit of the heirs, successors., administrators, and
assigns of eater Company and Liberty Life.
IN i~'ITNESS WHEREOF, the undersigned has hereunto set
his hand and seal on the day and year first above written.
