- continue to provide uninterrupted sewage service to the -
Motel Property.
2. Company shall maintain the sewage treatment
plant in such a condition so as to enable it to provide
all necessary sewage service to the Motel Property.
3. Company shall remain in good standing with
any and all governmental agencies charged with regulating
Company's sewage service,
4. The sewage service which Company shall supply
to the Motel Pro ert shall be undertaken
p y pursuant to the
same manner, terms and conditions as that provided to any
other commercial users served by Company, provided, however,
such "other Commercial users" shall not be deemed to
include any business owned or operated by George A, Costa,
Lucille V. Costa or any firm, corporation or trust in which
either of them has an equitable or beneficial interest or
- any operative control; and provided further that in the
event there are no "other commercial users" serviced by
Company, then any comparison or interpretation of the
manner, terms or conditions of Company's sewage service.
to Motel Property shall be undertaken in relation to sewage
service by any other utility company in St. Lucie County,
Florida, to commercial users, r?hile also taking into account
Company's size, capabilities and service area.
S. In the event Company sells or transfers
ownership of the sewage treatment service, Company shall
cause the successor owner to assume the obligations of
this Service Agreement and covenant to continue sewage
service to the Motel Property pursuant to the terms contained f
herein. F
6. Both of the undersigned parties hereto, for
themselves and their heirs, successors, administrators and
assigns, understand and agree that should sewer service be
