STIPULATION
All of the parties to this cause do hereby stipulate and agree as
follows:
1. Statement of Case. In August of 1976 the Plaintiff, LIBERTY
LIFE INSURANCE COMPANY (Hereinafter referred to as "Liberty"), filed
this action to foreclose its mortgage and security agreements and for
judgment on its guaranties as more particularly set forth in the Com-

~ plaint herein. The Defendants, ST. LUCIE ENTERPRISES, INC., FIRST
t - NATIONAL BANK OF FT. PIERCE, FLORIDA, ASSOCIATED INNS, INC., ESCAMBIA
INNS OF DOTHAN, INC., SANTA ROSA INNS, INC., ESCAMBIA INNS, INC., and
ETOWAH ENTERPRISES, INC., all filed answers or motions appearing in the
cause. Shortly after the filing of the action, GEORGE A. COSTA,
LUCILLE V. COSTA, BEARS NEST and various other Costa-owned or controlled
corporate entities filed a proceeding requesting an arrangement under
Cha ter XI of the Bankruptcy Act, said proceeding having been filed in

the United States District Court for the District of New Jersey and

designated with Bankruptcy No. B-76-2704. The United States District
Court for the District of New Jersey accordingly entered its Qrder
appointing a receiver and enjoining and restraining the Plaintiff
