The other Defendants herein do - hereby and have consented and agreed to the arrangement set forth in said documents and acknowledged the superiority of the lien of Liberty i by execution of the following documents: Consent to Forebearance Agree- I ment, Acknowledgement of Subordinate Lien, which are attached hereto as Exhibits C and D. In addition, the parties hereto have and intend to execute additional documents intended to comply with the provisions of the ~ Forebearance Agreement (Exhibit A) and the agreements between the parties and desire the Court to recognize said documents and approve the same and enter its Order approving this Stipulation and providing for abatement of this action pending compliance with the Forebearance Agreement and other documents as hereinabove set forth. It is specifically stipulated and agreed by the parties hereto that this foreclosure action shall be abated pending total compliance with , the terms of the Forebearance Agreement attached hereto as Exhibit A and payment of all arrearages required thereunder. (a) Upon compliance with the terms of the Forebearance Agreement attached hereto as Exhibit A and the payment of all arrearages required thereunder (there being no other default under the original loan documents ' attached to the Complaint herein), Liberty shall, within fifteen (15) days after such payments and compliances, file herein a notice that there has been such compliance with the Forebearance Agreement and that this cause shall be dismissed .without prejudice to refile the same in the event of a s later default. On the filing of such notice, this cause shall stand dis- missed without prejudice and without further Order of the Court. (b) In the event of any default under the Forebearance Agreement attached hereto as Exhibit A or further default under the original loan _ documents attached to the Complaint herein, Liberty shall file a sworn ~ motion setting forth the default and praying for entry of a Judgment of 3 Foreclosure within fifteen (15) days after the filing of such motion. Said motion shall set forth the nature of the default and the amounts then due under the Note, Mortgage and Forebearance Agreement. 6Jithin - -4- an~K 320 PAGE I C t
