to subsection (c), at the end of said subsection, the word "and," and
also by adding a new subsection (d) as #ollowa:
"(d) a dollar amount equal to one-tenth of one percent (O.lq'o)
of total telephone plant of the Company in service for any one
occurrence, but not more than one-half of one percent (0.5%)
of total telephone plant of the Company in service in any calendar
year."
Ssrriox 14. The Original Indenture as heretofore supplemented
and modified is in all respects ratified and confirmed by this Twenty-
Third Supplemental Indenture, and all the provisions herein contained
shall be deemed part of the Original Indenture in the manner and to the
extent herein provided.
SECrIOS 15. Wherever reference is herein in this Twenty-Third
Supplemental Indenture made to a Section or Article of the Original
Indenture and such Section or Article has been amended by any one
or more supplemental indentures, then such reference shall be to such
Section or article as so amended.
Sscrio~ 16. The Company convenants that it is lawfully seized
and possessed of the property described in the granting clauses of this
Twenty-Third ~ Supplemental Indenture and that it will warrant and
defend the title to said property to the Trustees for the equal pro rata
benefit of the holders of all bonds at any time outstanding under this
Indenture against the claims and demands of all persona whatsoever.
S$criox 17. For any default by the Company in the covenants,
Stipulations, promises and agreements contained in this Twenty-Third
Supplemental- Indenture, or in any previous supplemental indenture,
the Trustees and the bondholders shall have the same rights and
remedies, subject to the same limitations, as are provided in the Original
Indenture.
S$criox 18. The covenants and agreements herein contained shall
inure to the benefit of and be binding upon the respective successors
and assigns of the parties hereto.
S$cTiox 19. This Twenty-Third Supplemental Indenture may be
simultaneously executed in any number of counterparts, and all of
